As the Senate Minority Leader, Mitch McConnell (R-KY) said, "The Democratic Majority has repeatedly failed to treat judicial nominees fairly." At the beginning of this Congress, the Democrats said they would meet or exceed the average of 17 circuit court nominees that have been confirmed in prior Congresses; yet they've only confirmed eight circuit court judges thus far. In fact, the Chairman of the Committee, Sen. Patrick Leahy (D-VT), recently threatened to shut down the confirmation process completely, an action that would break yet another historical precedent. The Democrats said they would treat Republican senate delegations fairly; yet for months, the Democrats have only worked on circuit court nominees from states with a Democrat senator! The Democrats said they would do their "utmost," said they would do "everything possible," said they would do "everything within their power" to confirm three more circuit court nominees by the Memorial Day recess; yet they only confirmed one nominee. Moreover, it's now obvious that the Democrats did not seriously attempt to honor their commitment; in fact, since that deadline passed almost two weeks ago, the Democrats have still failed to confirm more circuit court nominees. The Democrats have refused to honor their commitments. They apparently believe that commitments don't matter in the United States Senate, and that actions don't have consequences.
