Governor Deval Patrick said yesterday he is studying whether he can bypass the Legislature to clear the way for illegal immigrants to pay in-state tuition at state colleges and universities, triggering criticism from Beacon Hill Republicans on an explosive issue that has reverberated nationally.
Speaking before a group of business and civic leaders, Patrick said his legal team is weighing whether the state could grant the lower rate by passing a regulation, which would require approval by the 11-member Board of Higher Education.Patrick's comments, in response to a question from an audience member, came two years after an in-state tuition bill failed in the Legislature, and amid a debate over illegal immigration in the presidential race.
Paying in-state tuition would save illegal immigrant students thousands of dollars. At the University of Massachusetts-Amherst, out-of-state tuition is close to $10,000 a year, compared with about $1,700 a year for residents. Out-of-state tuition runs as high as $8,430 a year at a community college compared to about $700 a year for residents.
California, Texas, and New York are among severalstates that allow illegal immigrant students to pay resident rates, but in Massachusetts a similar push failed in 2006 after an emotional debate in the Legislature.
After the breakfast, Patrick emphasized that he supports in-state tuition for illegal immigrant students but has not decided how to proceed.
"We have been asked by a number of people whether it is possible to address that question without legislation," he told reporters after the breakfast sponsored by the think tank MassINC at the Omni Parker House in downtown Boston. "The answer to that is by no means clear."
The governor's comments revived the prickly debate in Massachusetts over whether illegal immigrants should pay lower tuition. Advocates for immigrants accuse the state of punishing students - including some valedictorians - for their parents' choices and effectively shutting them out of college. Opponents of granting the lower rates say illegal immigrants should not enjoy the same benefits as residents.
The Massachusetts Republican Party issued a statement slamming Patrick for rewarding "illegal activity."
"It's bad enough to encourage and reward illegal activity while sticking it to legal immigrants and other taxpayers who obey the law, Robert Willington, executive director of the state Republican Party, said in a statement.
State Representative Bradley H. Jones, Republican of North Reading, said he would consider filing legislation to bar illegal immigrants from paying in-state tuition if the governor decided to circumvent the Legislature.
"It's the wrong policy direction to go in," he said.
In 2005, the state Senate passed a measure that would have granted in-state tuition to illegal immigrants who have lived here for at least three years, earned a high school diploma or the equivalent, and intended to seek legal permanent residency. But the measure failed in the House the next year and faced a certain veto by then-Governor Mitt Romney, who has since made illegal immigration a key issue in his presidential campaign.
But Michael Widmer, president of the Massachusetts Taxpayers Foundation, said the state could benefit by educating immigrants and integrating them into the workforce.
In 2006, his organization estimated that the state's public colleges would gain $2.5 million a year in new revenues in tuition and fees by 2009 by allowing illegal immigrant students to pay in-state rates. He estimated that illegal immigrant enrollment would grow from nearly 100 students in 2006 to 600 students in 2009, a small portion of the 160,000 public college students in the state.
"It's in the interest both economically and fiscally for the Commonwealth to allow these students to attend public colleges at [in-state] rates," Widmer said. "Economically we're losing many of these students. They are just the kind that we want to educate and who will stay in Massachusetts."
Yesterday, the governor acknowledged that granting in-state tuition to people here illegally is controversial, but he affirmed his support for it.
"I think this is the right thing to do. It's a matter of fundamental fairness," he said. "But I don't have the answer yet on how to fix this. I want to fix this, but I don't have an answer for you."
Where does this jerk get off saying it is a matter of "fundamental fairness"? Fair to whom? These students have no right to even be in this country. He needs to consider what is fair to this nation's citizens.
The problem, as I see it, is that these people who have been elected as representatives of the people, have forgotten why they were elected, and who elected them. They are always trying to figure out a way to circumvent the laws, to appease the lawbreakers and their supporters. VOTES, VOTES, VOTES. And, not the votes of citizens. Mammaw, That's where we come in. It's up to us to educate as many people as possible. I am always sending things to people, and the ones who don't have emails or computers, I try to print as much information and get it out to as many people as I possibly can. You would be surprised at how many people change their opinions once they get the information. They get hungry for more, once they find out what they stand to lose.
I say it's up to us to educate the people, because the media and the politicians want to keep everyone in the dark. An educated person is too hard to control, so if they can keep us ignorant, they can control us.

I, too, keep sending e mails and talking to everybody I can. Constantly. And I ask them to pass the word along. I never ask them to vote for anyone. That turns some people off. I give them facts and ask that they not take my word for it but to check it out for themselves. That way they don't feel as if I'm trying to force feed them my views. I tell them about FS and other means of information. And John you are right about them getting hungry because I have had them come back and say how right I was and that they never knew such things were going on.

After a great triumph for Oklahoma and the nation against the forces of illegal invasion, Randy Terrill, author of H.B. 1804, has more plans. According to a report in the Oklahoma media :
When the Legislature returns in February, Terrill said he plans to file what he is calling the “son of HB 1804.” He said he will seek to make English the official language in Oklahoma. The bill also will allow law enforcement not only to hold illegal immigrants until they can be deported but will give authority to seize assets used to transport or house illegal immigrants. School districts would have to provide a more accurate accounting of how many children, here illegally, attend their schools. The law that went into effect this month ends practically all public services for illegal immigrants except for schooling and emergency health care…

Terrill also would like to crack down on children whose mothers come to the United States to give birth. The U.S. Constitution states children born in this country are U.S. citizens. He would like to see the state be able to 'refuse' to issue a birth certificate for these children, instead requesting one from the consulate of the parents’ nation of origin.
This is great news, because if we are to get a handle on this problem, the anchor baby loophole must be dealt with as soon as possible.

Before they give an "illegal" in state tuition....GIVE ME A JOB WITH MY NEW DEGREE! How about my 50 Grand (plus) in student loans? I'll be 46 when I graduate this May. My career was destroyed by 9/11 and these idiots want to give stuff away to illegals instead of ensuring that our OWN people have access to education?! There were thousands upon thousands like me immediately after 9/11. Our careers went down the tubes as those buildings fell into a heap.....DO YOU SEE US TAKING IT LYING DOWN? I will be paying off student loans LONG INTO MY SENIOR YEARS! Do you see me complaining? A little...but I'm doing what any red blooded American does after tragedy- I got back on the horse.
Enough stuff for these illegals already....we are giving away the country piece by piece! I'm sure there are other Americans like me who had to decide on a new career path after 9/11......why not give US the tuition break for College?!
