President Bush has disappointed his staunchest supporters no few times during his presidency – but nothing, not even his failed attempt to force a flawed immigration bill upon the nation, has been more disappointing than his refusal to pardon or commute the sentences of the incarcerated border agents Ignacio Ramos and Jose Alonso Compean.

On Dec. 11, 29 convicted criminals received presidential pardons. They included persons convicted of tax evasion, bank fraud, drug smugglers and dealers and a moonshiner. However, while President Bush was willing to extend the ultimate gift of the season to corrupt criminal elements, he stubbornly refuses to show the same forgiveness to Ramos and Compean. Unquestionably, criminal elements are now free to enjoy Christmas with their families while the two border agents languish in prison, separated from theirs.

Ramos and Compean are serving 11 and 12 years, respectively, after being convicted of assault, obstruction of justice and civil rights violations related to the wounding of Mexican drug-smuggler Osvaldo Aldrete-Davila. On Feb. 17, 2005, the agents chased Davila near the U.S.-Mexican border outside of El Paso, Texas, after Davila abandoned a van containing 743 pounds of marijuana with an estimated value of more than $1 million.

As the border agents attempted to apprehend Davila, he wrestled with Compean, ultimately escaping. As he fled, Davila produced and pointed an object that Ramos thought was a gun. Ramos fired at the fleeing Davila, but thought he had missed. In reality, Davila had been wounded in the buttocks, yet still managed to escape across the Rio Grande, where be met an accomplice who then drove him into Mexico.

Prosecutors claimed the agents had violated Border Patrol policy when they pursued Davila without supervisor approval, that Compean moved shell casings, and that both did not properly report the shots fired. Testifying against Ramos and Compean, under the veil of immunity from prosecution for his actions on the night in question, was none other than Davila himself.

T. J. Bonner of the National Border Control policy noted in Senate testimony that jurors were not told of Davila's continued drug trafficking after he was granted immunity (something for which he has since been indicted), nor that an agent who testified against Ramos and Compean is a life-long friend of Davila (a clear violation of agency policy). Bonner also testified that the shooting was justified by both Department of Justice and Border Patrol policies – and that a medical examination of Davila had supported the agents' description of events. Still, Ramos and Compean went to jail.

From the beginning of the agents' prosecution, there has been a bitter public outcry and wide ranging, bi-partisan congressional support for the border agents – all of which has fallen on deaf White House ears.

It can be argued that the agents may have dispensed their duties in a way that on some level inadvertently abrogated the strict letter of their proper protocol. It cannot be argued that they are being punished proportionately for the offense.

President Bush has made a habit of letting his penchant for brash bravado cause himself and his party embarrassment. He did it standing on the deck of the USS Lincoln when he declared, "Mission accomplished." He did it when he tried to convince his base and the nation that Harriet Miers was the quintessential best pick as the nominee to be a Supreme Court justice – leaving us to ask in retrospect: "If said were true, what did that make replacement nominee Samuel Alito?" He did it when he stood before a global media in Softa, Bulgaria and boasted, "I'll see you at the bill signing," in reference to the flawed immigration bill that subsequently suffered a much-deserved ignominious defeat. Now he purposes to make an even more egregious error in judgment by ignoring the pleas for forgiveness for two of the agents responsible for securing our borders. Something one could be forgiven for assuming he has little real interest in doing.

Ramos and Compean have already spent over 11 months in Prison.  

Yet, Mr. George W. Bush has Not Freed Them.

Mr. George W. Bush is a huge and monumental Disgrace for not having yet completely commuted or Pardoning and freeing these two wrongly imprisoned and former Border Patrol agents from Prison.  Ramos and Compean are Political Prisoners of the Bush Administration.  Mr. George W. Bush along with his 'very dear’ friend Attorney Johnny “House of death” Sutton need to be held accountable for this very outrageous and travesty of justice.

Great article, but I would think if Bush is ignoring the thousands and thousands of letters and emails and faxes he's received on behalf of Agents Ramos and Compean, he's sure not going to be swayed by this.  I think he needs to be hit...literally!....over the head with the matter.

Hi!  It is very Unfortunate and very Disgraceful that Mr George W. Bush has not Commuted the very Excessive and Wrongful Prison Sentences yet, of wrongly convicted and former Ramos and Compean.  Especially in light that Mr. George W. Bush completely Commuted the whole 30 month Prison sentence of his dear friend Scooter Libby.  Scooter Libby did not have to even serve one day in Prison. Yet these two wrongly imprisoned and former Border Patrol Agents have already served over 345 days in Prison.  Enough is Enough.  Free Them Right Now!.

Once When Ramos and Compean get out of Prison and get Freed very likely by the U.S. 5th Court of Appeals, Mr. George W. Bush along with his 'very dear' friend Johnny "House of death" Sutton, and also Debra Kanof need to be held accountable for this very outrageous and travesty of justice.

You know, it's times like this I wish I personally knew the Bush twins well enough to get an invite to the ranch.  Or maybe some of the president's best buds.  Anyone "out of the loop" of the beltway, and could ride his hind end mercilessly during his visits to Crawford and / or Camp David.

This is just so wrong.  And anyone who can or will do anything about it is completely out of touch.  I have called and faxed until I'm blue in the face, and I doubt seriously my messages get past the front line of "defense".

Now that the primaries have kicked off, the question of who will pardon Mr's Ramos and Compean would make a great debate question.......

What you are seeing is the real GWB and his cronies in goverment.Sutton is known in T exas as a DC cronie.If Bush says jump he,well you can guess the rest.As a Texan lifelong,I feel Bush is an peariah.We as true conservatives are disgusted with that man and his goverment.Remeber that before 9-11 his poll numbers where inn the toliet.For shame how they have destroyed these two good men and their fams.Our goverment is sick and perhaps in the future some lipton needs to be dumped in some bay some where.I say this only because what happen to those two agents,can easily happen to any of us.Welcome to America 2008.Our founding fathers are truley spinning.

I will NEVER write or call that man we call President (but he thinks of himself as KING) George W. Bush!  I too have written several times and called the White House Switch Board.  I left the Democrat Party because of Clinton and his CORRUPT regime, and now I find that Bush's is just as bad!  But then I started doing some research and have found out what many of you all know.  We have being divided (Democrats and Republicans) to conquer us.  These evil Elites know they'd be in deep do-do if we unite.  And illegal Immigration has proved that!  Isn't that the irony of it all?  It took the egregious incarceration of 2 border patrol agents for many people to wake up and smell the coffee.  It's a darn shame that we hadn't seen through the Administration sooner, but then John Kerry would've been the same disaster-just a better orator who probably knows how to pronounce nuclear!




God Bless the USA and all those who put themselves in harms way to protect and defend
us!

Entirely too true, Pam.  I saw the "divide and conquer" ideology happening a little over 4 years ago and went Independent.

"The Democrats have said this about the Republican party.." 

"The Republicans have said that about the Democrat party.." 

I left that kind of crapola in grade school. Thankfully to forums like this one, we can see there's a growing number of others .  Long way to go, but we can do this if we're focused.

The media could so easily keep Bush's feet to the fire on this one, but what are we hearing?  Caucas and debate news 24 / 7, exit percentages, and polls of, "Who are you voting for?"  And as long as the media can keep up that pace, Mr's. Ramos and Compean will stay right where they are.    They're not "news" anymore, which is totally unacceptable.

You are right on the money, it'd scare the peewads out of the power suits if we could all work together and get our wonderful country back on track; and before it's you or me going the trip for doing our jobs the right way, as Nightflyer so rightly pointed out.

Oh, and Nightflyer: I have some of that Lipton....Cool
