Father of four sons killed by illegals on the job!

My 39 year old son was killed by an illegal placing the wrong I-Bolt into a wall.  He apparently didn't understand our weights and measurements.  He couldn't speak the English language very well either.  The State Labor and Industry hid the fact that the men involved with his death were illegals!    The police who investigated the death over looked that small detail!  Now ICE, is trying to tell me my son's death means nothing to their investigation!  They will only charge the employer with a crime of hiring illegals "IF" they can prove he knew they were illegal!!  Appearantly, my sons death isn't important!  It's been called an ACCIDENT, and that's where everyone wants it to remain!  I AM fighting this, and I am demanding someone charge the employer with a criminal charge as well as the job foreman!  They ran an unsafe job site because of the illegals!  They knew the men were illegal, and hired them to cut down on their pay roll.  I'm sure they also hired them in order to bid jobs at a lower rate!  This is America everyone!  Are we going to stand for our fellow Americans being killed by these bastards?  Are we going to allow ANYONE to hire them, and get away with it?  ALL employers who hire illegals should do prison time.  If there's a death involved, they should be charged with murder!

You Bet there is!  I can't post it until after the first of the year though because of the investigation going on with ICE right now!  I can hardly wait to post my sons picture, and the story!!  Thank you for asking..........

I am sorry for your loss....how can ICE keep you from talking? So far we still have freedom of speech! I think they are pulling your leg....unless of course they will charge these people (as they should) if you don't.  If that's not the case call your senator, representative, your local paper and Lou Dobbs....

I want to thank ALL of you for your support!  It's people like you, who help my family and I get through this season.  My son was killed on December 30th, and his fourth son was born on January 1st.  I will always remember Christmas, as the last times I talked with him.  As far as ICE not wanting me to talk, the agent said the investigation will most likely be a covert one.  I don't want to spill the beans in case the owner, foreman or the illegals somehow hear.  They would all be gone!  I'll let ICE do their job (we'll see what that is), and then I plan on doing MINE!  Whether they put the owner in jail, whether they deport the illegals makes no difference really.  I will tell the world WHO they are, and HOW it happened!  I'm tired of my sons death being "just an accident!   I want people to know HOW he died, and WHY!!

Two years ago right now, my son was dieing!  All the memories, all the DETAILS are as though it's just happened.  Anyone losing a child will never be the same person again.  But to lose a child for a senseless action or act,  is unbearable!  We have to stop the illegals from working dangerous jobs here in our country.  AMERICANS going to work in the morning, lunch boxes in hand, should not end up dead two hours after arriving at work because an illegal who couldn't speak or understand our language, did something wrong causing a violent and horrific death!  Those people have gotten away with this........so far.  Everyone blew it off as an accident.  Everyone is protecting their butts, and protecting the illegals and employer!  I will post a couple of addresses here soon.  I will ask each of you to PLEASE send a letter of how you feel about this.  I'll post a fax number as well...............

Tanc4prez, I do have legal representation for a civil suit only.  I can't seem to get anyone to charge the employer or the job foreman, who's job it was to run a safe job site, with any crime what so ever!  I've already stated what ICE has told me. Just this morning, I talked to a commander at the police station that called the death an accident.  I was told by him, that they would take another look, but for me not to get my hopes up because it's not considered a crime to have an unsafe job sight.  Even if  someone is killed.  When I reminded him that since it's a crime to hire illegals, and they were directly involved with his death, it is a crime, his answer was: No, actually the illegals didn't kill your son, the wall did!!  Do people realize how protected these illegals really are??  I've decided I'm calling Judicial Watch to see if I can get any strong arming from them.  Then as soon as the police go over the paperwork I've sent, and call me back telling me my sons death isn't a crime, I'm going to release phone numbers for everyone here to call and let them know how you feel.  I can't sue the company he worked for (you can't in this state) now I have to see if I can go after the job foreman for Negligent Homicide from a civil angle.  It's so frustrating to live with the fact that no one is being charged with any CRIME!

Can the employer be held civilly responsible and made to pay damages. It seems to me that our tort system is made for this, but I could be wrong.

From OSHA:

 

"Willful Violation - A violation that the employer knowingly commits or commits with plain indifference to the law. The employer either knows that what he or she is doing constitutes a violation, or is aware that a hazardous condition existed and made no reasonable effort to eliminate it.

Penalties of up to $70,000 may be proposed for each willful violation, with a minimum penalty of $5,000 for each violation. A proposed penalty for a willful violation may be adjusted downward, depending on the size of the business and its history of previous violations. Usually, no credit is given for good faith.

If an employer is convicted of a willful violation of a standard that has resulted in the death of an employee, the offense is punishable by a court-imposed fine or by imprisonment for up to six months, or both. A fine of up to $250,000 for an individual, or $500,000 for a corporation, may be imposed for a criminal conviction. "

IMHO, a skillful lawyer could charge that the hiring of someone who cannot read or understand safety rules on any site should be able to press charge of OSHA violations as well as "gross negligence".

 I am not a lawyer but I see how the ACLU and that ilk attack us--we should do the same.

I'm trying, but this state has Work mans Comp. through L&I and "because" of that, you can't touch the employer.  Now, I don't know about individual employees.  I want to go after the job foremen who allowed this to happen.  I just got a response from my Representative.  They want me to fill out an "Assist for Congressional help".  They did however, tell me they couldn't prosecute.  They can only ask questions!  Believe me, that will get me no where.  They all have their LEGAL pat answers!!  They're all protected from NOT doing their job!  Possibly having a State Representative contacting them might stir up a scare, we'll see.  I have a call in to Judicial Watch. I was told that the man I called, will contact me tomorrow when he gets back in.

See a successful personal injury attorney. Your son was killed. This is not workman's compensation. We have verification systems in place that prudent employers use to see if someone is working here legally or not. When a case is made successfully that an employer was operating in a reckless manner with little regard for safety and human life, then perhaps recovery of damages can occur and a message be sent to those ignoring and disregarding our laws meant to safeguard us.

John Wunderlich, you're right!  I'm not sure you are understanding fulling what I'm trying to do.  I do have an attorney who is suing a "third party" because we can't sue the direct employer.  The third party I've been told is going to make an offer soon!  Now, THIS is only for a TRUST FUND for the four little boys my son left behind.  I'm suing for my grandchildren in other words.  That "is" being done.  The third party then.......CAN sue my sons employer directly.  It's confusing as H*LL.  What I'm trying to do on my own, is make the employer himself and the foremen himself and the illegal himself be charged with a crime!!  No one will charge any of them with a crime so far.  His death has just been written off as an ACCIDENT!  I'm trying to let Americans know how this works!  Illegals are being protected here, AND so is their employer!  All the agencies who are suppose to be charging these people......aren't!  This family wants for his death to be registered as a death by an illegal.  We don't want the system to get away with this!  Think about all the death's like my son's, that aren't being reported.  It needs to be added to the list.

Foxglove;  You need to fight to be allowed to testify before Congress.  I don't know what this takes but there are some good members like Jeff Sessions and Byron Dorgan who really stood up for the American people during the amnesty debate in the Senate and Brian Bilbray, Duncan Hunter, Ted Poe and others in the House.  Your situation is the kind that needs to be shoved in Congress' face.  Then they can't deny that these illegal aliens cause harm.  I'm sure there are alot of others out there who have lost loved ones also and would stand with you.  We, as Americans, cannot let this be swept under the rug.  Writing letters and e mails, sending faxes and making phone calls isn't the answer in this case because the actual members of Congress never answer the phones or read our letters or faxes.  It is just a member of their staff.  You need the opportunity to speak dirrectly to them and prsent the facts and how you have been treated.
