EEOC SUES SALVATION ARMY

The headline is correct. The Federal Government has filed suit
against the Salvation Army and is targeting other businesses
that require employees to speak English on the job.

The Salvation Army Thrift Store being targeted by the Equal
Opportunities Commission (EEOC) clearly posted its "speak English"
requirements and gave employees one year to learn the language.
But the EEOC still filed suit saying this was a "civil
rights" violation.

And it's getting worse. Last year, over 200 similar charges
were filed with the EEOC -- up from just a handful ten years ago.

+ + Nancy Pelosi sides with EEOC’s anti-English attacks

To make matters worse, Nancy Pelosi and Congress' Hispanic
Caucus have teamed up to block an effort to put an end to
the EEOC's attacks on businesses that require English.

Sen. Lamar Alexander (R-TN) proposed a provision to the Commerce,
Justice, Science Appropriations Bill (HR 3093, S. 1745) that
would prevent the EEOC from such legal attacks.  The full Senate
passed the bill--with the Alexander provision. The House also
greed to the amendment, but later withdrew support after the
Hispanic Caucus threatened to stonewall other House bills unless
the provision was removed. Speaker of the House Nancy Pelosi
agreed, saying the House will not vote on the bill until the
English language provision is terminated.

in other words, Pelosi and a small group of Congressmen
are defending the EEOC's efforts to sue organizations like the
Salvation Army that require English on the job!

I have already sent faxes, will call tomorrow

So why is our government (the EEOC) not also suing companies that require a prospective employee to be bi-lingual?  Isn't that also a violation of their civil rights?  Dang - here I go again tomorrow!  It's like we're fighting a foreign government - not our own!

Oh goodie!  Can I sue the local nail gallery because I have to listen to every nail tech chatter away in Vietnamese?  Can I now sue the phone company or doctors or grocery store or department store because I have to sit and listen to, "Hello...hola...para Espanol......" or flip an instruction manual in 20 different ways to get to the English version?  I noticed today at the P.O. all the new signs up in Spanish, Portugese, etc.  Just how much ink and paper are we wasting with that BS?

Yes, it costs a lot of money to print things in multiple languages. And what does Al Gore and his environmentalist buddies have to say about the tremendous amount of trees that have to be cut down to make all this paper? Isn't it enough to have a tax code that is longer than the novel, "War and Peace"? Now, every print job from the government printing office is doubled or more just to accommodate an illegal population that is not interested in our laws or way of life. Do we even know how many, percentage wise, can read?

The decision of a business to require a specific language is really that business’ decision.  The government should have no say in what language a business must use.  If the business chooses to use <fill in the language of your choice> that is their decision.  The fact that they may be alienating some of their potential customers is part of the choice they make.  There are places I can go in THIS country where the business owners don’t speak English.  Is the EEOC going to go after them for not speaking English?  Don’t count on it.

Like Aaron Russo when he was kicked off of the grounds of the IRS building for filming there, I ask, "Where is the law?  What law did I break?  Show me the exact law."

And should such an unonconstitutional law exist, have your lawyer remind the jury they have the collective right to nullify the law in their verdict.

This is definitely the most assinine lawsuit I can think of.  What a waste of taxpayer dollars.  The Salvation Army is a great institution and they certainly have the right to require English to be spoken.

Besides being a ridiculous suit, I read the other day that these Spanish only speaking immigrants (legal and illegal) remain at the poverty level for generations after they first arrive.  Gee, I wonder why.  Could it be they refuse to educate themselves and learn our language and assimilate more into our culture?

We need some patriotic attorneys out there to help us out and go after all the school systems and other entities that either refuse to hire or let go employees who do not speak Spanish.  I refuse to use the word bilingual because we all know it is not about any other language but Spanish.  I've repeatedly contacted my senators and rep. complaining that they don't want the American people to be bigoted against Hispanics yet I don't hear instructions or read instructions in any other language but Spanish.  So why wouldn't we be against Hispanics.  They are the problem.  If all the crap that's out there was in German we would be ticked off at Germans.I'm telling you, our government thinks we are really stupid.  The only thing I can see maybe coming out of this is that it may stop people from hiring anyone Hispanic so that they won't have to worry about this kind of crap.  We can only hope.

As I stated on ANOTHER post, I called EEOC again this morning and kept the poor man on the phone for 15 minutes....I was very nice and polite, but firmly stated that WE THE PEOPLE are highly offended by this lawsuit. Then I asked him 2 questions:

1- What country do we live in? He said "America"

2- What language has been spoken by WE THE PEOPLE for almost 300 years? He said "English"

I said, Why then are you suing the Salvation Army? An entity that has done nothing but HELP people- ALL PEOPLE...regardless of race or religion. Also asked him why should I have to Press "1" for English in MY country? He said nothing.

He said a "single" person has filed this suit...he would not give me the name of WHO represents this person unless I could tell him what state this happened in. It was not in the article above, so I felt like an idiot...I am ALWAYS prepared before I make calls like this and today I was not.

Has anyone else made progress with this? We need to go to the source....the people representing this IDIOT plaintiff.....I was unable to get ANYWHERE with the EEOC. I tried! Does anyone have NEW or pertinent information that would help out?

BioTech Babe, I pulled the part below out of an article I found, It was Framingham, Mass.

But that's exactly what the Equal Employment Opportunity Commission is trying to do. In March the EEOC sued the Salvation Army because its thrift store in Framingham, Mass., required its employees to speak English on the job. The requirement was clearly posted and employees were given a year to learn the language. The EEOC claimed the store had fired two Hispanic employees for continuing to speak Spanish on the job. It said that the firings violated the law because the English-only policy was not "relevant" to job performance or safety.

I just called Pelosi's comment line and asked if she and her staff spoke fluent Spanish. Because if they didn't, then she is backing a law that even she can't follow. I told her this was leading to a "Tower of Babel" in our country and as a U.S. citizen and California constituent, I firmly resented her stance on this.

Good question to ask, Jani.  We should ask the EEoC the same thing.

Jim Boulet, executive director of English First, is appalled by the recent decision of the Boston Office of the EEOC to file suit against the Salvation Army for firing two employees who refused to learn English. The Christian social service organization had given the two women one year to get proficient in the language and to speak only English in the workplace.

Boulet says the Salvation Army was actually doing the women a favor. "Now, these women could have been allowed to just sit there sorting used clothing for the Salvation Army," he suggests. "Evidently they were doing a good enough job of that to be kept on; but that's not a road to improvement for them or their families. So, instead of running a little linguistic ghetto, the Salvation Army said, 'Learn English.'"

The English language advocate points out that a federal judge in Boston upheld the Salvation Army's English policy in a similar case in 2003. The organization "was sued for this very same policy -- in the very same courtroom -- and won," he notes; and yet, "the EEOC, with your tax money and mine, is making the Salvation Army defend again its policy of trying to encourage people to seize the opportunity that America has to offer by learning English."

Boulet says he is glad the service organization is fighting the suit again and "really proud that the Salvation Army hasn't just folded its tent on this one." He says the organization has "stood up for its principles" in this case.

And the English First spokesman is not alone in supporting the Salvation Army's stance. In a news release, Congressman Tom Tancredo (R-Colorado) also blasted the EEOC over what he called a "frivolous lawsuit."

BiotechBabe;  I don't for one minute believe that "Single person" garbage.  All the person you spoke to is doing is passing the buck.  I hope the Salvation Army beats this bad rap again.  But who knows how a different judge will rule.
