Tancredo Seeks to Overturn 'No Match' Court Ruling

Republican Presidential candidate and Congressman, Tom Tancredo, announced that he plans to introduce legislation that would overturn a recent federal court ruling preventing the Department of Homeland Security (DHS) from sending "no-match" letters to potential employers of illegal aliens.

The letters would be sent to employers that have employees that have submitted fake or incorrect social security numbers. The agency was prepared to send 8.7 million letters prior to the preliminary injunction.

"Congress must take out the legs from underneath the court's misguided ruling with legislation," said Tancredo. "By giving DHS direct authority from Congress to send out the no-match letters, the court would be hard pressed to find another excuse to prevent DHS from enforcing our immigration laws."

The federal district court judge, Charles Breyer of San Francisco, ruled earlier this week that DHS had exceeded its authority in issuing new no-match letters to employers.

The new letters require employers to verify employee Social Security Numbers and submit new paperwork to DHS. If the employer still refuses to do anything about potentially illegal employees within 90 days, DHS' new rule says that he may be held criminally liable.

"After years of prodding, DHS finally is trying to take the single most effective step to curb illegal immigration---going after rogue employers," said Tancredo. "DHS is trying to give its no-match letters teeth and the American public shouldn’t have that effort short-circuited by some San Francisco judge."

Tancredo says that the “illegal alien lobby – big business addicted to cheap workers and labor unions hungry for more members – went to court and won a preliminary injunction to stop the letters from being issued.”

According to Tancredo Judge Breyer's ruling is based solely on the allegation that DHS had exceeded its rulemaking authority that Congress had granted it. Tancredo's bill would take DHS' rule and give it direct effect from Congress, thus circumventing the administrative law claims upon which Judge Breyer's ruling is based.

Tancredo has been a leading advocate in Congress of ending illegal immigration and calling on President Bush to protect U.S. borders.

Way to go Tom T.  My guess is even if a new law passes, the bleeding hearts will pursue its "unconstitutionality", and find another sympathetic judge to once more delay the process.  Hope not!


TEXAN...NO - I WON'T FORGET THE ALAMO! "Where's the Fence???" RINO huntin' season started January 10th (but ended January 22nd)! FRED has left the building!!!! MITT has entered my world! Oops, MITT left my world too soon also (on February 7th)! Dang, can't catch a break -- but Hillary, Obama, and McCain aren't it either (nor Huckabee, Paul, Keyes, Nader, ad nauseum)!

If a sympathetic judge is found once again, then it would be time to ignore his/her order as being unconstitutional per the last two paragraphs of the story.  Its time to run rough-shod over these "screw-what-We the People-want-done"  judges that are legislating from the bench.

It just blows my mind!  I am working on an article for all of the legislation Tom is responsible for to ease and control the problems of illegal immigration and how to solve them.  I am happy to add this to the list.

Once again, Tom steps up to the plate to try to stop the "illegal immigration" denial syndrome.  It flabbergasts me, as well, all the legislation he has put forth.  He is one busy and concerned legislator, and loyal American citizen.

 It just makes me realize all the more how we need this man to lead our country in some capacity.

Tom not only has the right ideas for our country, he has the right plan (in my opinion) for his campaign.  He wants to represent THE PEOPLE and is not accepting contributions to his campaign from any corporate or special interest group.  THE PEOPLE must get behind Tom and put their money where their mouth is; contribute to his campaign, help spread his message, change voter registration in closed primary states if necessary and speak at the ballot box by casting a vote for him; don't just hope he wins so you can vote for him in November.  HELP MAKE IT HAPPEN.

It does not surprise me that it is Rep Tancredo who is going to bat once again.
