Do you remember the Colombian student and his cousin who were facing deportation for not going back to their country of origin? Well, one of them was in Washington, DC today asking the Senators to pass the DREAM ACT!
This week, The Dream Act will rear its ugly head as Senator Dick Durbin tries to insert it into our Defense Authorization Bill. On Friday, Durbin stated:
What I tried to do several years ago was to write a law to take into consideration these young people. It is called the DREAM Act. The DREAM Act was a part of this comprehensive immigration reform bill. Here is what it says: If you came to the United States before the age of 16, if you have lived in this country for at least 5 years, if you graduate from high school, and then if you will complete either 2 years of college or 2 years of service in the military, we will give you an opportunity for legal status in America.
On the floor of the Senate, when we return next week, we will resume consideration of the Defense authorization bill. It turns out that many in the Department of Defense believe, as I do, that the DREAM Act is an important part of making certain we have talented young men and women ready to serve in our military. I have spoken to people at the Department of Defense who support the idea of the DREAM Act. I think we ought to include it in the Defense authorization bill. I hope to have that opportunity. [snip]
I hope when we return to the Defense authorization bill we can make the DREAM Act part of that bill. Certainly, it is going to help our defense and help our military. I think it is going to help America even beyond that. [snip]
Mr. President, as I said, I rise to speak about legislation known as the DREAM Act, which I hope to offer as an amendment to the Defense authorization bill.
And Durbin goes on to say how much Americans need these illegal aliens - our military will crumble without them, ahem, well, at least according to Durbin:
Some people might ask why the Senate should revisit immigration again and whether an immigration amendment should be included in the Defense authorization bill. The answer is simple: The DREAM Act would address a very serious recruitment crisis that faces our military.
Under the DREAM Act, tens of thousands of well-qualified potential recruits would become eligible for military service for the first time. They are eager to serve in the Armed Forces during a time of war. And under the DREAM Act they would have a very strong incentive to enlist because it would give them a path to permanent legal status.
Trying to hide amnesty for illegal aliens in the Defense Authorization bill by pretending that it is necessary for our Department of Defense and our military is a bunch of hooey and we all know it.
The DREAM Act doesn’t mandate military service. A student who is otherwise eligible could earn legal status by attending college. It would be inconsistent with the spirit our volunteer military to force young people to enlist as a condition for obtaining legal status.
But the DREAM Act creates a strong incentive for military service. And many DREAM Act kids come from a demographic group that is already predisposed towards military service. A 2004 survey by the Rand Corporation found that 45 percent of Hispanic males and 31 percent of Hispanic females between ages 16 and 21 were very likely to serve in the Armed Forces, compared to 24 percent of White men and 10 percent of White women.
Ok, that’s Dick Durbin’s spin on the Dream Act but let’s get a few thoughts from a person that actually possesses a bit of sanity and wisdom…
But in-state tuition isn’t the only ‘gift’ in the Dream Act that Koback found:
This amnesty opens a wide path to citizenship for any alien who entered the country before the age of 16 and has been in the country for at least five years. As with the rest of the Senate bill, the guiding notion seems to be “The longer you have violated federal law, the better.”
Beyond that, all the alien needs is a high school diploma or a GED earned in the United States. Alternatively, he need only persuade an institution of higher education in the United States—any community college, technical school, or college—to admit him.
The DREAM Act abandons any pretense of “temporary status” for the illegal aliens who apply. Instead, all amnesty recipients are awarded lawful permanent resident (green card) status. The only caveat is that the alien’s status is considered “conditional” for the first six years. To move on to the normal green card, the alien need only obtain a degree from any institution of higher education, complete two years toward a bachelor’s degree, or show that doing so would present a hardship to himself or his family members. Of course, an alien with a normal green card can bring in family members and seek citizenship.
Furthermore, the DREAM Act makes it absurdly easy for just about any illegal alien — even one who does not qualify for the amnesty — to evade the law. According to Section 624(f), once an alien files an application — any application, no matter how ridiculous — the federal government is prohibited from deporting him. Moreover, with few exceptions, federal officers are prohibited from either using information from the application to deport the alien or sharing that information with another federal agency, under threat of up to $10,000 fine.
Thus, an alien’s admission that he has violated federal immigration law cannot be used against him — even if he never had any chance of qualifying for the DREAM Act amnesty in the first place. The DREAM Act also makes illegal aliens eligible for various federal student loans and work-study programs.
What part of NO don’t these clowns understand? The American people have angrily tried to shout down amnesty and public benefits to people who illegally enter this country but Durbin and Company continue to try to spend our tax dollars on it anyway.
It is typical for our elected officials to betray us by taking parts of failed legislation and attaching them to legislation that they know will pass.
This has to be stopped now or the amnesty bill we just succeeded in killing will be resurrected and passed - piece-by-piece.
We are going to have to watch these guys like a bunch of two-year-olds. I’ve got to tell you, friends, I sure get tired of babysitting them and I hope we elect some adults in 2008.

Since your victory over the Comprehensive Amnesty in the Senate in June, the pro-amnesty forces have been planning to mount their new assault. The fight has begun with Congress' return to Washington, D.C.
The pro-amnesty forces' plan: They will forgo attempting an amnesty for the minimum of 12 million total illegal aliens. Instead, they will seek an amnesty for 1.5 million illegal farmworkers (which will also result in a few more millions of their close relatives being allowed to be amnestied or invited right away).
The pro-amnesty forces' vehicle: An attempt will be made to add the text of S. 237, the AgJOBS amnesty introduced by Sen.Diane Feinstein (D-Calif.), to the farm bill (H.R. 2419), which passed the House on July 27 without amnesty provisions.

By and large, this is the same AgJOBS amnesty that was introduced last year. The AgJOBS agricultural guestworker-amnesty bill would reward thousands of illegal aliens with amnesty. Of the 1.2 million illegal aliens currently working in agriculture, an estimated 860,000, plus their spouses and children could qualify for this amnesty, so the total could reach three million or more. This bill would also provide amnesty for employers who broke the law by hiring illegal aliens.
Pro-amnesty advocacy groups are telling their members that Sen. Ted Kennedy (D-Mass.) and Sen. Feinstein have promised them that the AgJOBS amnesty will be attached to the farm bill this fall and be passed into law.
Nothing less than the level of your effort in May and June will prevent the Ag Amnesty from going through this fall!
Please send this fax to your representative who has been good about voting against amnesties in the past, and ask him or her to oppose this unnecessary amnesty for illegal aliens and their employers as well.
Why this amnesty is unnecessary:
POINT #1: We don't have an epidemic of crops "rotting on the vine." A few anecdotes are often allowed by the media to create a totally false picture of the overall situation. We've heard these scare tactics from the pro-amnesty forces for years. Somehow, we never seem to run out of food.
POINT #2: The federal government offers the H-2A visa which allows farmers to import unlimited numbers of foreign ag workers for specific short-term work. If some growers lack workers, it is only because they failed to be creative enough to attract a domestic workforce or failed to use the legal foreign guestworker program that is available to them.
POINT #3: Growers who refuse to use the H-2A program mainly do so because they have to pay an almost decent wage under the program, while illegal aliens are cheaper.
POINT #4: If growers find the H-2A program too cumbersome, they should direct their lobbyists to support H-2A reforms instead of amnesty.
MAIN POINT: Americans will do this work - at a decent wage. The Department of Labor finds that the majority of farm workers (about 55%) in the U.S. are native-born Americans!

WASHINGTON ---- Immigration officials have granted Kendall brothers JUAN and ALEX GOMEZ an additional 30 days in the United States, giving them more time to plead their deportation case before Congress.
The extension also covers their parents, according to attorneys for the FLORIDA IMMIGRANT ADVOCACY CENTER.
The news comes just a day after the FIAC coordinated a lobbying campaign for JUAN GOMEZ, who met with House and Senate staffers to push for passage of federal legislation, DREAM ACT that could keep him and thousands of other undocumented immigrant children in the United States.
Lawmakers who have championed the case celebrated the news.
U.S. Rep. LINCOLN DIAZ-BALART, R-Miami, has filed a "Private Bill" on behalf of the two college-age teens and the extension gives House officials more time to take up the issue.
The family was ordered deported back to Colombia on July 25 but an intensive lobbying effort by Juan Gomez's friends and lawmakers resulted in a 45-day deportation stay.
That extension expires Sept. 14. The additional 30 days gives the Gomez family until Oct. 14.
CHERYL LITTLE, executive director of the FLORIDA IMMIGRANT ADVOCACY CENTER, said the deportation could be delayed as long as 2009 if the immigration subcommittee takes up the matter.
U.S. Rep. ILEANA ROS-LEHTINEN, R-Miami, suggested Wednesday that the time extension would give lawmakers more time to lobby for federal legislation that could help the brothers stay in the United States and would give their attorneys additional time to pursue the case in immigration court.
''We will use this time wisely to garner further support,'' Ros-Lehtinen said.

I am listening to Dave Elswick on KARN, Little Rock. He has a guy on from FAIR and they are discussing the DREAM ACT.
Had it not been for Sen. Session calling a press conference and "blowing the whistle" on the bill, no one would have known about. He said DURBIN wanted to RUSH it through WHILE NO ONE WAS WATCHING.
This bill gives CONDITIONAL LAWFUL PROVISIONAL RESIDENT STATUS to ANY ILLEGAL who has graduated from HS, gotten a GED, or is already enrolled in higher ed. In tohers words, SHAMNESTY.
It will also give IN-STATE TUITION to EVERY ILLEGAL IN THE U.S. Every ILLEGAL accepted into a college or university will mean AN AMERICAN WILL NOT BE ACCEPTED.

Elswick is URGING EVERYONE TO CALL, WRITE, FAX, EMAIL, protesting the DREAM ACT ATTACHED TO THE DEFENSE APPROPRIATIONS BILL. He said this is the MOST IMPORTANT AMNESTY BILL SINCE THE defeated COMPREHENSIVE IMMIGRATION REFORM BILL.

The DREAM Act was introduced by Senator Durbin of Illinois, and is currently awaiting consideration in the Senate Committee on the Judiciary. This legislation would award legal immigration status to hard-working students who have grown up in the United States and graduated from high school, but who are prevented from attending an institution of higher education because of their immigration status. The DREAM Act grants these students the opportunity to further their education and their contribution to our society. Should this bill come before the full Senate for a vote, I will support it.

Sen. Jeff Sessions, R-Ala., a leading immigration policy critic, said Wednesday that amendments planned for upcoming legislation could put more than 4 million illegal immigrants on a path to citizenship.
That is about one-third of the estimated 12 million illegal immigrants who would have benefited from the comprehensive immigration overhaul bill (S 1639) he helped kill earlier this year, Sessions said.
Sessions warned colleagues in a letter that legislation (S 774) labeled the DREAM Act that would allow states to provide college benefits to illegal immigrants could be offered as an amendment to the fiscal 2008 Defense appropriations bill (HR 3222) later this month. The measure could benefit 1.3 million illegal immigrants.
More alarming to Sessions was that Sen. Dianne Feinstein, D-Calif., plans to offer an amendment to the five-year farm bill that could come to the floor in October that could legalize 1.5 million farm workers. The Congressional Budget Office estimated they would bring another 1.8 million relatives into the country with them.
“To people who voted against the comprehensive package, they really should not vote for this,” Sessions said. “It’s one third of the total number and has less demands on the people who are here illegally.”
The reason for Sessions’ alarm was a July 25 colloquy in which Majority Leader Harry Reid, D-Nev., assured Feinstein of a vote on the so-called AgJobs measure, which she introduced earlier this year as a freestanding bill (S 340). “I will do everything I can to make sure it is part of the farm bill,” Reid said.
Sessions said Feinstein is negotiating a potential compromise with the ranking Republican on the Agriculture Committee, Sen. Saxby Chambliss of Georgia.
“It could blow up on the floor and cause a big fuss,” Sessions said. “We need to focus on the legitimate labor needs of the United States. But our focus should not be on how to serve people who are in the country illegally.”
