law terrorizing my wife

I went to the store one day on my 4 wheeler , comming back home a state police (adkins) pulled over a ways down the road in front of me so I looked both ways and crossed the road . When I turned on my road ( a narrow 1 lane two way road) he turned on his siren and lights , I thought he had a emergancy so I was going as fast as I could to get out of his way ( they have a loudspeaker but he never used it)he was moving far to fast and to close for me to pull over and a narrow road like I was on safely, when I turned into my driveway he tried to ram me broadside , it scared the heck out of me and I went on my own property up thru the woods ,still didn't think he was after me. My girlfriend came out to see what was going on and adkins said "did you see a whiteman with a fro on a 4 wheeler come thru here?" she said no and then he got in her face ,terrorizing her a threating her so bad she went into a siezure and the cop didn't even try to catch her , as she fell she hit her head on a big rock (could have killed her) then while she was in her siezure he stood there watching her bang her head on the big rock that she hit when the siezure started he didn't even move it , her son had to come out pull her from partway under the 4 wheeler and move the rock ,, now the cop won't file charges so I can get this takin care of and behind us , it's going to put my girlfriend in the hospital. what kind of people do we have as police? terrorizing innocent people

You can file a lawsuit for that. His negligence in not helping her is considered the same as if he'd intentionally bashed her head against the rock.

Please explain your title.  Law terrorizing my wife...but I keep reading and you mentioned my girlfriend? My question to you is why didn't you help your girlfriend? why did you hide? you could have avoided your girlfriend from having the siezure if you would just come forward and talk to the police or...you were expecting that reaction from a police officer?

Your story sounds very strange.

we are engaged and was scaired , I didn't know what he was after me for , I didn't evin know he was after me tell he tried to ram me and still it didn't occur to me tell after I was in the woods , I am still waiting and calling everyone  to find out why they were chasing me and no charges have been filed , it's been a week

My daugnter had a similiar experience on a 4 wheeler on a dead end street.

update : he finily called back my woman and said he was going to charge me with running , passing 3 cars on the wrong side of the road (that I was riding on the shoulder of) and trying to ram him (come on a 800 lb 4 wheeler aginst a 4000 lb car?? lol) but he won't file the charges he said he wants me to turn myself in first (so he can handcuff me to the bars and beat the crap out of me) it's happined to me before cause they didn't like me She told him that when the charges are filled I will turn myself in , but I'm not going to with no charges ,, would you turn yourself in with no warrants or charges aginst you ?

talked to a lawer ,, seems not only can Pat file charges but I can to ,so I don't think he will do anything ,, he had no reason to mess with me in the first place , I was breaking no laws . I have now found out if your over 18 you do not have to have a operators to ride a atv in the state of west virginia

Hi. I see the word is out. I know the story from the person in question. It is legitimate and accurate. The trooper was deliberately unhelpful when the victim went into the siezure, (after causing it with his intimidating and uncalled for verbal attacks and threats)! When the poor woman fell to the ground in a spasmodic siezure, the trooper just stood there making snide and derogatory remarks. When her son came out to try to help her, the trooper started threatening him with intimidating language and threats of incarceration for interfering with the law. The trooper even tried to put words in the son's mouth by re-stating, (with select variations),  what the son said. It's a clear case of "police brutality"!

In vew if the fact that he (the cop) might try to retaliate , would you put a civil case aginst the state and the cop?

So let me get this.  The police was chasing "somebody", you didn't know who.  You run (in you wheeler as fas as you can), the police was too close to you and he parked in your property and YOU still didn't think he was after you? So, he was after whom? a cat? I am sorry, I just don't bite your story.

So now you run into the woods but you saw your girlfriend and adkins said did you see a whiteman with a fro on a 4 wheeler come thru here? How did you hear the words when you ran into the woods? You said he got in her face TERRORIZING her and threating her so badly she went into the siezure and you still hiding yourself in the woods FROM THE COP? Why didn't you help your girlfriend or your woman, face the cop and finish the story? is the least thing I'll do if I was you! and now you want us to agree you want to sue the police officer?

If your woman went into a siezure there is no way the police will put his hand on her or help her and you know why? because if your woman die, his fingerprints will be on her and you can say as a witness that he killed her.  Plain and simple.

You were expecting the cop to help her and why didn't you do it? you are the boyfriend!!!!

What you expect us to tell you is go ahead and sue the darn cop! isn't it?

The cop was after you, you pretended it was not and you ignored him.  Plain and simple and now you are making seem it is the cops fault.  This wouldn't have happened if you just face the cop but you choose not to.

1st place this was all told to me BY witness that were there , I did not come to help her because I didn't know this was going on , and on every cop car it says " to protect and serve" are you really that dumb? well my lawer said I and my woman can charges to file , if he was in the right then why and I able to file charges aginst him?? why after 4 weeks as he not come to get me or put any charges?? why? because he knows we have him by the short hairs The cop is in the wrong , he had no reason to pull me over. we have decided to start procedings agins him and the state mon. thanks everyone

Trooper adkins is well known in the area for his bullying tactics! He is also well known for harassing others by abusing his authority as a police officer. It's common knowledge in the area that trooper adkins is very harsh and demeaning to everyone he deals with. On duty and off, it's reported that he throws his weight as a police officer around to intimidate people. He's a bad cop and needs to be removed! That's my opinion. And it's based on several eyewitness reports as well as my own personal dealings with trooper Adkins.

I too find this a wee bit fishy.

 

The main charges apparently are illegal passing (you state you were on the shoulder but the shoulder of a road is part of the road and where else would illegal passing on the right occur?)  and running away from him and yes, I can see a possible attempt to ram if he was as close behind as you indicate and you swerved wide to enter "your" driveway.

He could likely also add failure to give way to an emergency vehicle as well as operating an unregistered motor vehicle on a public roadway (which is what you were doing on the shoulder of a roadway).

If you didn't know you were the object of the chase why did you abandon the ATV in front of the house and head for the woods on foot in such a hurry?  Your story makes it clear that your girlfriend was "partway under the 4 wheeler ", so it becomes clear that you didn't run the ATV into the woods.  If not running from the police was it just a matter of it being time for your daily jog through the woods?

Mr. William Kent should have also noted that there are MANY in the area who praise Trooper Adkins because he does do his job and it is hard to imagine that he would stand idly by watching a woman beat her head on a rock. 

Mr Kent seems to give away some more rather pertinent information however when he states -- "just stood there making snide and derogatory remarks. "  That might explain the Trooper's taking no action if the woman's son was threatening him because like it or not any officer's first duty is NOT to protect others but to keep himself and other officers safe from sudden attack.  It is rather difficult to assist someone else if you are having to try to watch your own back and don't know if the person you were after will suddenly make an appearance (possibly armed).

One last discrepancy that is rather obvious but possibly missed by some is that if he was so close behind you you would have been in visual contact so he would have seen you running for the woods and not have had to ask your girlfriend.

 

Facts trump a 'might'.

I find this story as believable as a fresh pile of camel dung.  If anyone believes it, there's a bridge in Brooklyn that's for sale.

In this case the facts support the "might" (regarding stood there).

The facts as stated also support a valid chase for valid reasons but the facts DO NOT support the "I didn't know he was chasing me".

 

they have just changed the law here about 4 wheelers in this state and the legislature did not update it . That is the laws I was going by and it was legal to ride on the shoulder of the road for up to 10 miles and I did not "ditch" my 4 wheeler I rode it into the woods and got it stuck , I went to get help to get it off a log , they went on private property to get the 4 wheeler (I did not own the property it got stuck on) plus they rode it down, two on it and that is aginst the law , also if he wanted me to pull over all he had to do is say "pull over" on his loud speeker here is the address where the "laws" are posted check it out for your self Edward , http://www.legis.state.wv.us/WVCODE/1... acording to these laws that the legislature wrote I was breaking no laws , so why would I run ? I will get a lawer , get all of any charges dropped and sue the pants off the state and the trooper. They (the cops) say "ignorence of the law is no excuse" ok I see there point so how about up-dating those web sites (where 50 % of the people get there info) so we know the law... If the laws arn't right on the wv state legislature web page then it shouldn't be there and I fail to see how that can make me accountable for it
