Suspect May Be Illegal Immigrant

NASHVILLE, Tenn. -- A man charged with vehicular homicide in the death of a Texas college student was also being held on suspicion of being an illegal immigrant, police said.

Victor Javier Benitez, a 24-year-old native of Mexico, was being held in the Metro Jail Tuesday on $250,000 bond.

Police said Benitez ran a red light in his sport utility vehicle around 2:45 a.m. Saturday and struck the car driven by 22-year-old Joycelyn R. Gardiner. Witnesses "described an extreme odor of alcohol about Benitez and said that he was very combative," police said.

Both were rushed to Vanderbilt University Medical Center, where Gardiner died a few hours later. Benitez was treated for a head laceration and broken rib.

Gardiner, of Port Arthur, Texas, was a member of Tennessee State University's Tigerbelle track team. She was to receive her criminal justice degree in August and possibly attend law school. Funeral arrangements were pending, TSU officials said.

Benitez, who carried an identification card listing a Houston address, has been arrested several times, police said.

Last April, he was convicted on burglary charges and sentenced to one year of supervised probation.

Several months later, he was arrested on charges of public intoxication, disorderly conduct and resisting arrest, and was later sentenced to seven days in jail.

Yes, I heard this story on the news Tuesday.  They said he was driving a Ford Expedition...I guess when you're illegal, and don't have to pay taxes or auto insurance, etc., you can afford to drive an Expedition with it's 8 miles per gallon!!  What are the bets he STILL won't be deported?  Or, if charged with murder, LULAC or LaRaza or MALDEF or some such group will smuggle him back OUT of the country to avoid charges.

I see potential illegals everywhere where I live driving nice big SUVs. Not the cheap ones either. Eddie Bauer Expeditions, 4 Runners, Rav 4s, large trucks. Oh...and these are not beat up cars either. They are very nice! I cannot even afford to get one of these!

The reason they buy 4 wheel drive SUVs is because if they go back to Mexico, they avoid the 100% import tax on 2 wheeel drive American Cars.

4 wheel drive vehicles  bought used in the USA and taken to central or south Mexico or Central America are worth enough in profit to pay thier gas down and the trip back allowing them to go home to vist and make a profit while doing so.
