Do We Have a Constitutional Lawyer in Our Mist?

Question, Do we have such a person in our group here? If so, is there a way for us to place a class action lawsuit  against the Federal Government & State as well as Local to enforce the Constitution or put them in a lot of termoil for failing to uphold the Law of the Land. They are breaking the law, can we not do this?

There must be something as a group we can do, if we wage a lawsuit againt the Governments, it will piss them off & maybe get others who believe as we do, get on board to recover our Once Great Nation.

If all of us are aware of La Raza's real agenda - how come they are NOT being investigated for terrorism, fraud, etc..... And what agency would do the investigating? Please tell me it is NOT the DOJ!

What about Judicial Watch? Would they?

It is long overdo to disable and demolish La Raza and the other groups because they are driving the bus not the little illegal aliens you see marching in our streets, they are only a symptom of what's to come!

I figure if we Americans can take out the root of the problem which is La Raza and the other groups that will stop this madness.

Once exposed to the public for bribing politicians' and for an act of terrorism for the invasion to take over our Country and deport all whites back to Europe - then La Raza will start losing all there financial sponsors, for example: CitiCorp, Starbucks, Lockheed Martin, Washington Post because then nobody will want to be associated with a terrorist group! RIGHT.

So who do WE turn them into for investigation.

I would like to get the ball rolling on this one! Any suggestions would be great!

I know it can be done. Environmental groups have sued the government to enforce EPA regs, very recently in fact.

 I don't remember the name of the organization that takes on the ACLU on occasion, but you may want to look them up and talk to them.

If the Illegals can file class-action lawsuits (and they are) then we can too.  Maybe ACLJ, Liberty Counsel or Alliance Defense Fund can help us.  They help fight against 1st amendment rights being violated all the time.

Manfor, this may be the single most important thread on the web!  The Landmark Legal Foundation is another possibility.  We need some entity to act as an " American Citizens' Legal Union".  Spend some months compiling a list of Americans who have been injured by the illegal aliens that our government has brought here, starting with the families of the 48,000 innocents that they have killed since 9/11.  People who have lost their jobs to them,etc.  Then after we sue ICE, DOJ, El Presidente, (can we name members of congress in a lawsuit?), the border patrol, & maybe the mexican government, we can go after the Bank of America & other collaborators who have profitted from this treason.

I have some laws regarding this that I think would  be usual in aiding the fight:

The U.S. Supreme Court ruled in Plyler v. Doe in 1982 that illegal alien students are entitled to enroll in U.S. public schools at taxpayer expense. The ruling was made immediately prior to the 1986 amnesty and it was believed at the time that the illegal alien students would be amnestied as a result of that program. Also, the number of these students was small enough at that time that it would not create a significant hardship on the United States taxpayers.

The Court provided an escape from this directive. It noted in the decision that  the Congress could reverse the decision if the illegal alien students prove to be a  financial hardship to the taxpayers and if the students who are legally residing in this  country begin to have their own education negatively impacted by the presence of the illegal alien students. Both of these conditions apply today.

The impact of illegal immigration on education extends beyond the secondary school level. Several states, including California, Kansas, New Mexico, Oklahoma, Texas, Utah and New York, have passed laws granting in-state tuition rates for illegal aliens, an action in direct defiance of federal laws.

Title 8, Chapter 14, Sec. 1623 states: "an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a State ... for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit."

Despite the federal statute, U.S. House Speaker Nancy Pelosi (CA) said in February 2007 that she intends to move legislation that would improve citizenship and education opportunities for illegal immigrant students. The proposed federal legislation reverses Arizona's Proposition 300 requiring public colleges and universities to charge illegal immigrants out-of-state tuition rates.

Illegal immigration is a crime. Title 8, Section 1325 of the U.S. Code, “Improper Entry by Alien,” says any citizen of any country other than the United States who: 1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or 2) eludes examination or inspection by immigration officers; or 3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact; has committed a federal crime [emphasis added].

 

Violators may be fined or imprisoned for up to six months. Repeat offenders may be imprisoned for up to two years. Additional civil fines may be imposed at the discretion of immigration judges.

 

The U.S. Code also addresses those groups and individuals who assist aliens in illegally entering or residing in the United States.

Section 274 says:

 

“A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

 

Assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or

 

Encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or

 

Knowingly assists illegal aliens due to personal convictions.

 

Persons convicted of these crimes may be penalized with criminal fines, imprisonment and forfeiture of vehicles and real property used in committing the crime. Persons convicted of employing or contracting with an illegal alien without verifying his or her work authorization status is guilty of a misdemeanor.

Thank you all for taking the time to see if this would be a viable idea. I believe if we get this to everyone with our thought process we can slap a lawsuit against all levels of Government. We just need to find a Lawyer who has the same thoughts as we do, If we do find such a Lawyer he might do it Pro-Bono, so lets start the search. All I can think of at this time is Jay Sekulow of the American Center for Law and Justice.  He is fighting cases all the time.  I am not sure whether he is a Constitutional Lawyer, but I do know that he has presented cases before the Supreme Court and won.  He would be the one to contact. Also, he may know of another attorney who could file the case.

 I agree that with the general immigration laws that are already on the books (that are being broken now and continue to be broken) that a lawsuit would be the way to go.

This may be the only way we can act as a group and pull in others in. 

 

THIS MAY BE THE WAY TO GO!!!!I DON'T KNOW MUCH ABOUT THE LAW, BUT IF ILLEGALS CAN SUE FOR ALL THE THINGS THEY WANT, WHY CAN'T AMERICANS???? IF ENOUGH PEOPLE DO THIS IT SHOULD WORK???

We have to do everything in our power to stop what will be a travesty to this country. The mass mail in campaign is but one more way to get our voices heard in DC.......we are not just doing this one event but plan to cover other issues as well.......we also call e-mail, fax, sign petitions by Grassfire, NUMBERSUSA, FAIR .......everything and anything that it takes......your help in our event would be appreciated.......

 

Judicial Watch is another firm that sues the government.  I believe it was founded by Mark Levin, or maybe it was Landmark, but they sued the Clinton & Bush Administrations.  I would thionk we need lawyers who work in Constitutional law.  Shit, I'm on my kid's field trip all day tomorrow so I'm booked til Monday.  I wonder if my congressman would help.  Gary Miller is big on securing the border.  And maybe someone could call the Sekulow call-in show between 12 & 12:30 EDT @ the # above in p.hunt's post.  I'll bet he'd love to take that question on the air!!  HHHHHHHHmmmmmm  we have a legal call-in show out here on Saturday morning.  If I can get on then that will at least publicize what we're doin.  I"M SO FRIGGIN EXCITED!  Screw the politburo, we'll fix the problem ourselves, one way or the other!!
