Border Patrol agent charged with murder

Evidence shows illegal immigrant posed no threat, Arizona prosecutor says


PHOENIX - A U.S. Border Patrol agent was charged Monday with first-degree murder for shooting an illegal immigrant during a confrontation on the Arizona side of the border in January.

An investigation found that Agent Nicholas Corbett's killing of Francisco Dominguez-Rivera of Puebla, Mexico, was not legally justified, said Cochise County's top prosecutor, Ed Rheinheimer.

"We have concluded that the evidence shows that at the time he was shot, Mr. Dominguez-Rivera presented no threat to Agent Corbett," Rheinheimer saiCorbett was named in a criminal complaint that also charges him with second-degree murder, manslaughter and negligent homicide. Rheinheimer said that a judge will determine during a preliminary hearing which of the charges is best supported by the evidence.

Corbett's attorney, Daniel Santander, did not immediately return a message left Monday afternoon by The Associated Press.

The shooting, which drew condemnation from the Mexican government, occurred while Corbett was trying to apprehend Dominguez-Rivera and three others who were trying to enter the country illegally.

In the days that followed the incident, the Border Patrol said a scuffle had led to the shooting and the agent "feared for his life."

More than 300 pages of documents later released by Rheinheimer's office revealed that Corbett's account of what led him to shoot and kill the unarmed Dominguez-Rivera did not match witness testimony or forensic evidence.

Corbett declined to be interviewed by investigators but told other agents - whose accounts were part of the investigative file - that he came around the front of his sport utility vehicle, saw a man with a rock in his hand close to the rear of the vehicle and fired once when the man made a motion to throw it.

But three witnesses who were being apprehended along with Dominguez-Rivera - his two brothers and a sister-in-law - told investigators Corbett fired while pushing Dominguez-Rivera to the ground.

Rheinheimer said the evidence in the case corroborates the description given by the three witnesses.

Corbett remains a Border Patrol agent although he is not working in the field, said Gus Soto, a Border Patrol spokesman in Tucson.

Soto said the agency would make a statement on the charges on Tuesday.

I heard that! Of course we know they got SS cards and citizenship for their testimony. Why has it taken 3 months to get this investigated? Maybe I watch too much CSI,  but seems to me that with their so called evidence and "witnesses" they could have ruled sooner. I guess they had to go to Mexico and find the witnesses first.

I remember seeing something on this a while back...the agent said he wanted to tell his side of the story because he feared he would suffer the same fate as Ramos & Campean. I tried to follow-up but couldn't find anything about it...want to bet the Mexican government was involved in this too.

It appears our courts will take the side of the illegals no matter what. Wonder how many millions this will cost the taxpayers......I'm sure Green Cards..drivers license & social security cards are in order..

This is outrageous and very ridiculous, charging this Border Patrol agent with first-degree murder.  Here is the legal definition of first-degree murder:

MURDER, FIRST DEGREE - In order for someone to be found guilty of first degree murder the government must prove that the person killed another person; the person killed the other person with malice aforethought; and the killing was premeditated.

To kill with malice aforethought means to kill either deliberately and intentionally or recklessly with extreme disregard for human life.

Premeditation means with planning or deliberation. The amount of time needed for premeditation of a killing depends on the person and the circumstances. It must be long enough, after forming the intent to kill, for the killer to have been fully conscious of the intent and to have considered the killing.

I don't know most of the details and circumstances about and surrounding this shooting yet.  However, From what I do know about the details about this shooting, I do know that this Border Patrol agent is in No way guilty of first-degree murder.  This is truly indeed outrageous and very ridiculous.  This Border Patrol agent is innocent of the first-degree murder charge.  What is wrong with our Government and Justice system now?

Sutton is making a name for himself, not a very good one but a name. Now, they all want thier names in the paper.

The thing that frosts me is, they're using his brothers and sister in law as witnesses. Do they really, honestly, believe these people are going to side with the Border Patrolman?

The problem is that these border agents seem to have a propensity for leaving live witnesses at the scene.

Dead men file no lawsuits.

It appears our own government has turned its collective back on us.  Our soldiers are sent to war and then tried for "murder".  Our own border agents are doing their job and end up in prison.  These outrages are merely a series of events in a long chain that is designed to do one thing:

Bring the people to the brink of revolt. 

Once that happens....there will only be one thing left for the president to do:  declare Martial Law.  It is a very simple process if you think about it.  Remove the militaristic aspect of society (police cannot do their jobs due to litigation, border agents cannot do their jobs due to litigation, soldiers tried for civilian crimes in a theater of war), remove the people's weapons (gun bans), add a catalyst (illegal invasion, tax increases, higher costs of living), remove personal liberties, take away privacy, enact legistlation to prevent free speach, wait for the uprising, declare martial law, squash uprisings forcefully, suspend regular elections due to civil unrest, then.....declare an emperor of the NAU.  Some may think I have watched too many Oliver Stone movies.  To those, I ask a few questions:  does anything else make sense to you?  What other motives could be at work here?  What other purpose does all this senseless wrong serve?

If you step back and look at the events of the past five years, one can get a sense of what appears to be a plot.  A very well thought out plan to create a state of fear.  Once the "fear" runs rampant enough, humans will revolt.  It is in their nature.  When this happens, the current government will do the one thing it has left to do and that is the above described series of events.

Our "elected representatives" are nothing more than a mouthpiece for this plot.  Propaganda for a machine that will eventually destroy the foundations of this country.  Why?  Personal wealth is about the only thing I can rationally come up with.  The Bush family has gained their wealth through oil.  Period.  How much oil is there in Mexico?  Plenty.  Plus, there is plenty under  the Mexican territorial waters where we cannot drill right now.  Once the NAU is a practical entity, the Bush family will profit handsomely from the added resources of Mexico.  How long before the NAU decides to take South America?  Not long at all.  Aaaahhhhh...more oil and more money for those who benefit from these things.

The "State of Fear" is already in full swing.  We, The People, are not listened to because we do not matter in the grand scheme of things.  My fear is that once there is a civil war in the streets, our own president will attempt to put down such uprisings with military force.  Many things are currently in motion that will eventually lead to the end result that the NAU proponents want.  The cavalier attitude of our government officials is repulsive, at best.  Their attitudes lead me to comparisons of our founding fathers and the attitudes they had to deal with and endure from England.  While there are a few elected officials who are trying to bring about change.....they are either silenced or ignored.  We are the ones who can bring about change.  We would have to interrupt their timeline and/or their planning.  Once we rise....we will be the "bad guys" in all of this.  The rapidly fading "middle class" of Americans who bear the brunt of this outrage will be the hunted by our own government.  We are branded "racists" or "isolationists" by our elected representatives.  The president referred to the MinuteMen as "vigilantes".  Need I say more?

I fear that there are not enough people willing to alter their lives in order to bring about this change.  The average American citizen is too concerned with his lawn, the two SUV's in the driveway, the 2.3 children under their roof, the mortgage, retirement funds, college tuition, Saturday mornings tee time, etc, etc.  These Americans do not notice their civil liberties being stripped away piece by piece.  They do not see or understand the legal/moral/ethical outrages being brought to bear against the police/border agents/soldiers who are supposed to defend us.  These people just don't "get it".  They will be the last to know that their world simply does not exist any longer.  They will also place blame for that on those who rise against the coming eventuality.

What will it take, you ask?  I know what I feel it will take.  However, my visions and ideas may not appeal to others.  Nor would they be deemed appropriate to the moderators of this board.  While discussion, petition, emails, phone calls, faxes, and demonstrations are all worthy means to attempt to change the direction of this country............I feel the time for them has come and gone.  My way will certainly not be everyone's way.  However, I feel it is the only way.  I certainly hope that those of you who feel you can bring our representatives back into the "American Point of View" succeed and do so quickly.  I simply do not share such an optimistic outlook.  When the very president of our country has openly declared that foreigners are more important than the country's legal citizens.......then the government "of the people, by the people, and for the people" has ceased to exist.

Tyrants are in our midst.  They must be brought down.

Yes,I too believe another civil war is coming.Everything is pointing in that direction! Someone leaked a fuzzy video of what happened when the agent shot him,and now they want to find the person who leaked it to You-Tube.No kidding,they dont want everyone seeing what really happened!Looked to me like the illegal was trying to throw a rock or something at him.This is another agent being railroaded,just like Ramos and Compean,and Hernandez.Nothing was done until Mexico filed their complaint!If you cant find it on you-tube,then you can find the link for the video at www.immigration watchdog.com which is where I found it.See what you think.Yell

I wonder if they put a gag order on this man so he cant get his side of the story out.

The same thing is wrong with our justice system that is wrong with our president and congress. They are run by agendas and corporations.
